MEDIATION and CONFIDENTIALITY AGREEMENT

This Mediation and Confidentiality Agreement (Agreement) is made between the undersigned parties or party representatives (Party or Parties) or other participants in the mediation (Participants) and the mediator (the Mediator).

1.  AGREEMENT TO MEDIATE. The Parties agree to attempt to resolve their existing controversies in mediation and to work with Mediator Dana Curtis.

2. MEDIATOR’S ROLE. The Mediator will act as a neutral third party. The Mediator will not act as an attorney or advocate for any Party in this or in any future proceeding.

3. CONFIDENTIALITY. Except as provided below, the Parties, Participants and Mediator agree that all statements made in connection with or during the mediation are confidential mediation discussions. All statements are made without prejudice to any Party’s legal position and shall be inadmissible for any purpose in any subsequent civil proceeding. Any information disclosed by or on behalf of a Party to the Mediator shall be confidential and shall not constitute a waiver of any privilege. The Mediator shall not testify and shall not be subpoenaed by a Party to testify in any future proceeding relating to this matter. The provisions of California Evidence Code sections 1115-1128 shall apply fully to this mediation, except as provided below. Any files or notes created or maintained by the Mediator, other than the Confidentiality and Mediation Agreement, are solely for the Mediator’s use and shall be destroyed following the termination of the mediation.

The Parties, Participants and Mediator agree that the Mediator may disclose any communication, document or writing involving information about or claims of elder abuse or neglect as defined by California Evidence Code sections 15610.07, 15610.30 and 15610.57.

4. FEES AND DEPOSIT. The Mediator’s fee shall be $___ per hour. The total fee shall be based on the number of hours (billed in tenths of hours) for all time spent in connection with the mediation, including but not limited to intake, telephone calls, correspondence, including e-mail, study time, the mediation session(s) and follow-up conferences or correspondence.  The parties agree to allocate mediation fees as follows:  ________________________________________.

In order to reserve a mediation date, the Parties agree to deposit estimated fees in the amounts determined by the Mediator by ________. The Mediator shall refund any unused fees or invoice the Parties for fees exceeding the deposit at the conclusion of the mediation. The Parties agree to pay any additional mediation fees within 10 days of receiving a statement showing a balance due.

The Mediator may charge interest at the rate of 10 percent per annum on balances unpaid for more than 30 days.

6. CANCELLATION AND RESCHEDULING POLICY. If the scheduled mediation is cancelled or rescheduled more than 2 weeks before the mediation, there shall be no charge for the change. If the scheduled mediation is cancelled or rescheduled for any reason with notice of between 7 and 14 days, a fee in the amount of one-half of the value of the time reserved will be charged to the Party responsible for the change. If the mediation is cancelled or rescheduled for any reason with notice of 6 days or less, the entire amount of the value of the time reserved will be charged to the Party responsible for the change. If the Parties disagree as to who is responsible for the change, the Parties shall each pay their pro rata share of the forfeited fee, without waiving any right to reimbursement by the other party at a later time.
